The Primate, by and with the advice and consent of the College of Bishops of this Church, shall, from time to time issue official Canonical Forms, with directions thereunto provided, for general use throughout the Church.
Such Canonical Forms shall be published in a formal Schedule and may be attached as an appendix to any official publication of these Canons.
In each Province of this Church, the Metropolitan thereof, by and with the advice and consent of his College f Bishops, shall be authorized to issue, from time to time, any additional Canonical Forms thought to be necessary for use in that Province concerned not provided by the means set forth in Canon 1 above of this Title.
Such additional Canonical Forms shall be published in a formal Schedule and may be attached as an appendix to any official publication therein of the Constitution or Canons, no h, of that Province concerned.
Until such time as there be respectively a Primate and College of Bishops of this Church as set forth in Canon 1 above of this Title, the Metropolitan of the Original Province of this Church by and with the advice and consent of his College of Bishops, shall exercise the duty and authority provided in said Canon I therefor.
Enacted by the Third Synod of the Original Province of the Anglican Catholic Church at Mobile, Alabama, October 22-25, 1980, and as amended by the Fourth Synod of the Original Province at Kansas City, Missouri, June 9-12, 1982, the Fifth Synod of the Original Province at Orlando, Florida, October 17-20, 1983, and the Seventh Synod of the Original Province at New Orleans, Louisiana, September 30 to October 2, 1987.
(1) Pursuant to the provisions of Article XIX of the Constitution of the Anglican Catholic church and to the provisions of Canon 11 of Title XI of the Canons of the same, there shall be established a Seminary of the Original Province of the Anglican Catholic Church whereby the sound education, intellectual, spiritual, theological, and moral training of men for the Sacred Ministry of the Church shall be effected, and in particular shall provide adequate means of the formation and development of the priestly character, humility, and spirituality required for the Diaconate and the Priesthood.
(2) Provided such activities do not interfere unreasonably with the religious and holy purpose of the Seminary as set forth in Subsection 1 above and provided that these activities and undertakings reasonably do not divert resources from that same purpose aforesaid, said Seminary may provide for the continuing education of the Clergy or the Laity, or both, of this Church, as well as the preparation of men for Seminary education; may provide training necessary or required by or under, or both, the provisions of the Constitution or Canons, or both, of this Church, as the case may be, for Deaconesses, Lay Readers, Lay Workers of the Church, and other such lay ministers, as the College of Bishops of the Original Province may, from time to time, deem necessary or suitable; and may create, publish, and disseminate various materials of a religious, informational, or educational nature, as the College of Bishops aforesaid may, from time to time, deem necessary or suitable, with the consultation, approval, or consent, as the case may be, that may be required by Canon or decision of the said College of Bishops, or both, of the Administrative Council of the Original Province, whichever is applicable in that instance concerned.
(3) Said Seminary shall be located upon property already obtained or to be obtained for such religious and holy purpose.
Said seminary, as an ecclesiastical corporation and entity and non-collegiate moral corporation, with right to own and administer property in accordance with and pursuant to the provisions of the Constitution and Canons of this Church, for the holy and religious purpose aforesaid, shall, as the College of Bishops of the Original Province of the same shall, from time to time, deem advisable or suitable, or both, and so determine and direct, be organized or incorporated, or both, as a subsidiary entity of the Original Province of this Church under appropriate civil statutes and laws as may be applicable In that instance concerned.
Such authority of determination and direction as aforesaid above shall be reserved strictly to the said College of Bishops without exception.
(1) The administration and government of said Seminary shall be vested in a Board of Governors.
Said Board of Governors shall consist of the following members with seat, voice, and vote therein and thereon:
(a) The President thereof who shall be the Metropolitan of the Original Province, or if he shall decline to serve as President, then a Bishop of said Province chosen for that purpose by the College of Bishops of the said Province from among their own number and who shall serve at the pleasure of the College of Bishops aforesaid until the election of new Metropolitan.
(b) The Metropolitan and all the Bishops Ordinary of the Original Province of this Church by virtue of their Dignity and Office in the Church of God and all other Bishops of said Province as of the date of the VIIth Synod of said Province.
(c) Three members elected by the Senate of the Clergy of the Synod of the Original Province of this Church.
The term of tenure of Office of each member so elected by said Senate of the Clergy shall commence upon the adjournment and prorogation of the regular meeting of the Provincial Synod aforesaid at which such Clergyman was elected and such term of tenure shall expire upon the adjournment and prorogation of the third regular meeting of that Provincial Synod aforesaid subsequent to the regular meeting of said Provincial Synod at which such Clergyman was elected.
The Senate of the Clergy aforesaid shall not elect more than one (1) member to a full three synod term of tenure at any singular regular meeting of the Provincial Synod aforesaid.
Those members by the Senate of Clergy aforesaid elected to full terms of tenure and are presently serving in Office under the provisions of previous editions of this Statute shall be deemed to have been elected under the provisions of this Stature and may serve out the remaining terms of Office under the provisions then in force and effect.
(d) Three members elected by the Assembly of the Laity of the Synod of the Original Province of this Church.
The term of tenure of Office of each member so elected by said Assembly of the Laity shall commence upon the adjournment and prorogation of the regular meeting of the Provincial Synod aforesaid -at which he or she was elected and such term of tenure shall expire upon the adjournment and prorogation of the third regular meeting of that Provincial Synod aforesaid subsequent to the regular meeting of that Provincial Synod at which he or she was elected.
The Assembly of Laity aforesaid shall not elect more than one (1) member to a full three Synod term of tenure at any singular regular meeting of the Provincial Synod aforesaid.
Those members by the Assembly of laity aforesaid elected to full terms of tenure and are presently serving in Office under the provisions of previous editions of this Statute shall be deemed to have been elected under the provisions of this Statute and may serve out the remaining terms of tenure of Office under the provisions the in force and effect.
(2) In the event a vacancy occurs in the Board of Governors by virtue of the death, resignation, or otherwise, of a member elected respectively by the Senate of the Clergy or by the Assembly of the Laity as aforesaid, the Prolocutor of the Senate of the Clergy, or the Speaker of the Assembly of the Laity, as the case may be, may appoint from among the membership of the appropriate House or those designated by such House, a successor to serve until the adjournment and prorogation of the next regular meeting of that Provincial Synod. At the said next regular meeting of such Provincial Synod, the appropriate House shall elect a person of that State and Order concerned to fill the vacancy for the unexpired term of tenure of that Office concerned, if any, of said member.
In any instance where a member so elected aforesaid above whose partial term of tenure of Office exceeds and is more than a two Synod term, then such member shall not be eligible to stand election to a full term of tenure of Office at the meeting of Synod whereupon the adjournment and prorogation thereof such partial term of tenure of Office concerned remaining shall expire.
(3) No elected member of the Board of Governors shall be eligible for more than two full consecutive terms of tenure of Office without exception.
(4) The President of the Board of Governors shall be empowered to accept the resignation of any elected or appointed member of the Board of Governors from the membership thereof and in the name of the said Board.
(5) In the event that any elected member of the Board of Governors shall absent himself or herself, as the case may be, without the express written leave of the President thereof, from the meetings of said Board or such member shall refuse to attend such meetings, or both, for a period of twelve consecutive months, and following upon, and in spite of, the written remonstrances of the President of the said Board to attend said meetings thereof, arid if such unwarranted or unjustifiable absence shall continue for a further twelve consecutive months period without the express leave as aforesaid, then it shall be competent for the President of the Board of Governors to send a formal canonical written Notice to such aforesaid member concerned that on a date six months later than the date of his Notice aforesaid such President intends to declare that member's Office on the said Board canonically vacant, unless and save by that date such President shall have received from such member aforesaid a written demand to be heard by the Board of Governors on some issue of fact, condition, or circumstance related to his absence aforesaid.
If the President shall receive such a demand, he shall arrange for such a hearing at the next meeting of the Board, and shall declare the Office of that member concerned to be canonically vacant save and only if such hearing shall have determined that such absence was in fact unwarranted or unjustifiable, or both, in accordance with the canonical procedures of due process of this Church for adjudicative tribunals and hearings.
Recourse of appeal shall be to the Court of the Metropolitan of the Original Province pursuant to the Canons of this Church for such appeals.
(6) Such Board of Governors may appoint non-voting members to the Board to assist them in the discharge of their duties and responsibilities as the Board may, from time to time, deem necessary.
(7) Such Board shall appoint the Dean of said Seminary. To assist the said Dean in the immediate administration and governance of the same, the Board of Governors shall appoint an Executive Committee from its membership and such selection shall be, as occasion may allow, based on the considerations of (a) educational expertise, (b) financial ability to fulfil such duty, and (c) availability to convene as necessity would command such Executive Committee shall consist of at least the President and Vice-President respectively of the Board aforesaid.
Such Executive Committee may act for the Board of Governors between meetings of the Board and shall make full written reports to the Board of any actions or decisions made for and in the name of the Board since the last meeting of the Board.
Such actions and decisions aforesaid by the Executive Committee shall be subject to confirmation and review by the Board.
(8) The Board and Dean, subject to the Constitution and Canons of this Church, shall have charge of and responsibility for all that pertains to the rules, regulations, and discipline of the Seminary and, pursuant to said Constitution and Canons, especially the Christian rights of the subject as set forth in Section 2 and 3 respectively of Article X of the Constitution aforesaid and in Canon 8, of Title IX, of the Canons of the same, shall adopt procedures in compliance to the same and of due process required of such tribunals in this Church.
Therefore, upon any occasion wherein said Board shall act as a tribunal, the right and recourse of appeal to the Court of the Metropolitan of this Province shall not be hindered or restricted by the Board or by any rules, procedures, or regulations set forth by the Board for such adjudicative hearings or proceedings.
Such Board likewise, pursuant to the Canons of this Church for such ecclesiastical entities and in compliance thereto, shall have charge of the temporal administration as well as the spiritual administration, and the advancement of the Seminary, and in fulfilment thereof, shall make appropriate regulations, as aforesaid in the first paragraph above of this Section, concerning the following, in particular, and to see that they are observed:
(a) pre-requisite studies and preparation needful for entrance to the Seminary;
(b) application procedures;
(c) requirements for admission;
(d) matriculation;
(e) grades;
(f) absences from the Seminary;
(g) appropriate dress for seminarians;
(h) requirements for graduation;
(i) degrees, diplomas, or certificates to be issued upon graduation;
(j) the course of study in conformity with the provisions and requirements of Canon 9 of Title XI of the Canons of the Anglican Catholic Church;
(k) expenses and living arrangements;
(1) devotional life and spiritual development;
(m) field work and education and clinical training;
(n) grounds and procedures regarding dismissal of students and faculty; and
(o) faculty and any engaged in the training of the students.
The Board has the duty and responsibility for examination Into any disciplinary or administrative controversies of a grave nature.
The Board of Governors, if not otherwise contrary to law or to the first paragraph of this Section, shall have always the authority to appoint, review, or dismiss the Dean or any instructors, Chairmen of departments, librarian or other such officers or officials as occasion may require.
(1) The Board, pursuant to the financial safety provisions and financial review provided by the provisions of Title XXI of the Canons of this Church, shall be responsible for the financial administration of the Seminary. To this end the Board shall appoint a Financial Officer of the Seminary, who shall perform the usual duties of a treasurer and, as such, shall be an Officer of the Board.
Such Official may also be named, pursuant to the provisions of Subsection (b), of Section 5.01 and Section 5.04, respectively of Canon 5, of Title XXI aforesaid, by the Administrative Council of this Province a Deputy Bursar of this Province for the said Seminary.
Such Official shall assist the Bursar of this Province pursuant to the provisions of Canon 6 of Title XXI, especially as regarding the monitoring of funds, inventory, and records of account.
(2) Such Financial Officer shall manage and be in charge of the incomes, expenses, and disbursements of the Seminary and be accountable to the Board for the conduct of his or her Office and shall act in concert with the dean.
(3) Such Officer shall assist the Board in the preparation of a proposed budget for each year between meetings of Provincial Synod in order for the Board to forward such proposed budget to the Bursar of the Province and the said Administrative Council as required of such Board to make pursuant to the provisions of Section 7.01, of Canon 7 of the same Title aforesaid.
Such Budget upon adoption by the Synod of said Province shall, pursuant to the provisions of Sections 7.04 and 7.05 respectively of the same Canon aforesaid, shall be the Official Budget and Financial Program of the Seminary and subject to such provisions contained therein for prudent review of such fiscal policy.
(4) The Board of Governors in the financial administration of the Seminary shall be fully subject to the provisions of Canon 8 of the same Title aforesaid in regards to the acquisition and disposition of property and of loans; shall be fully subject to the provisions respectively of Section 5.02 in regards to signatory authority and Section 5.05 in regards to bonding of Canon 5 of the same Title, shall be fully subject to the provisions of Canon 9 of the same Title in regards to auditors and the auditing of the financial accounts, records, inventories, assets, and other such financial matters of the Seminary; and shall make such reports that be required of the Board by the Administrative Council of said Province pursuant to the provisions of Canon 2 of the same Title as aforesaid.
(5) The Board shall, as long as such does not conflict with the laws ecclesiastical and the Moral Teaching of the Church, perform their duties in strict compliance to the banking regulations and laws of the civil jurisdiction in which the Seminary shall at any time be Situate as well as those of the United States Department of the Treasury, to the regulations and procedures of the Internal Revenue Service, and to the laws and statutes of the civil jurisdiction in which the Seminary shall at any time be situate, especially those laws and statues dealing with tax exemption, tax exempt entities, corporations, and the mode of holding real property and other assets which may be in the name of the Seminary.
(6) The Board shall also be responsible for the raising of revenues, monies, and endowments for the Seminary and, to this end, may appoint a development committee to assist the Board therein and therefor. Such committee need not be composed of members of the Board but shall be accountable to it and make written reports of its work thereto.
(1) The Dean shall be the Rector and Principal of the Seminary and shall have charge of the immediate administration and government of the same under the direction of the Board and with the assistance of the Executive Committee and in accordance with established and published criteria and procedures thereof and therefor. He shall, with the concurrence of the Executive Committee, appoint, discipline, or dismiss any instructors, librarians, confessors, or other such officers or staff members and assign them their duties as may be deemed necessary or appropriate in accordance with such procedures aforesaid.
(2) The Dean shall supervise and carefully watch over the training of the students who shall be put into his charge and safekeeping, see that the instructors properly fulfil their duties, and the students observe the rules, regulations, and follow the course of study set for them, and be a spiritual father and guide to them.
Said Dean shall not attempt to pressure or coerce in any fashion or manner the Manifestation of Conscience on the part of those subject to his charge and safekeeping.
(1) The following principles shall be implemented at the discretion of the Board of Governors as may be practicable at the time or as circumstance may require or allow as the Seminary develops.
(2) The spiritual development and devotional life of the students is to be nourished by a framework of prayer and thorough regime of spiritual exercises as follows:
(a) the daily recitation in common of Morning Prayer and of Evening Prayer, with the Litany, if possible, in the accustomed time before the daily Eucharist on Wednesdays, Fridays, and Sundays;
(b) the daily celebration of the Holy Communion;
(c) the reception of the Holy Communion frequently, with due devotion and preparation; and
(d) provision made for daily meditation or mental prayer.
The students are expected to attend these services except for good and sufficient cause prevented or upon leave of the Dean.
(3) Also there shall be, as much as possible, the practice of Greater or Grand Silence following upon the recitation of Compline in common, attendance being optional, until upon completion of the next morning services, and Lesser Silence in the evening study hour and during the set hours of instruction.
(4) Each student is expected to attend a weekly lecture or instruction on the fundamentals of the spiritual life.
(5) A Quiet Day at least once each term shall be conducted as opportunity provides and a spiritual retreat in common shall be held In each year, especially, if possible, before graduation or nay ordination.
Said Seminary in what regards the jurisdiction of the Bishop Ordinary of the diocese or other such jurisdiction in which it be situate, shall be Exempt therefrom as an Ecclesiastical Peculiar directly under the Ordinary Jurisdiction of the Metropolitan of the Original Province of this Church.
Unless the said Metropolitan shall make the Canonical Visitation to the Seminary for each year in his Person Metropolitical, the President as the Episcopal Visitor thereto shall make such Canonical Visitation for him in that year concerned.
(1) The Board of Governors shall prepare a written Statement and Report each year on the work; progress; number of students and graduates of that year; the instructors, with their qualifications and courses for which they are responsible; audited report pursuant to Canon 9, of Title XXI aforesaid; budget, budget implementation, prudent review of budget, any subsequent revisions thereto, and expenses; financial condition; endowments and income; and any other matter of import. Such annual written Statement and Report shall be made to the College of Bishops of the Original Province and to each Diocesan Synod or Synod of other such jurisdiction of said Province.
(2) Said Board shall prepare also a complete written Statement and Report similar to the above for the years since the last regular meeting of the said Provincial Synod for the next regular meeting thereof and be made thereto.
(3) Said Board shall be held responsible for what is contained in such Statements and Reports aforesaid.
Enacted by the VIIth Synod of the Original Province of the Anglican Catholic Church at New Orleans, Louisiana, September 30 to October 2, 1987
The Metropolitan and the College of Bishops of the Original Province of the Anglican Catholic Church shall have authority to implement the provisions of Canon 10 and Canon 11 respectively, of Title XXI of the Canons of this Church, after consultation with the Administrative council thereof.
The Administrative Council aforesaid shall have charge of administration for the College of Bishops aforesaid of such plan or plans or scheme or schemes, as the case may be, that such College shall direct and order implemented.
Said Administrative Council shall provide and make available to the Clergy of this Province and others so concerned, from time to time, as necessary, the plan or plans or scheme or schemes in place, arranged, or changed by periodic Information for the Clergy or Notices for the Clergy to be distributed by the Bishops Ordinary of this Province and by notices in The Trinitarian to the same.
