Summary
DETR - Circular 36/78 - Trees and Forestry.
This circular was published in July 1978 and consolidates advice from
earlier circulars which have now been cancelled; cancelled circulars are (DETR
99/72, 6/74, 147/4, 17/75 and Welsh Office 37/68, 1/69, 55/70, 219/72, 15/74, 24/75).
Some of the advice given in this circular has now been superseded by later documents,
however, much of it is still applicable, the following subjects are covered.
- Local authority plans and tree planting (policy, local plans, training,
tree council, public involvement, species selection, planting & maintenance, planting
on roadsides).
- Central government financial assistance and tree planting (forestry
commission schemes, public access, regional advisory committees, grants, tree planting on
government owned land).
- Trees in the countryside (new agricultural landscapes, trees and upland
landscapes, ADAS, nature conservation and the countryside, hedgerow trees and hedges,
damage to trees from controlled burning).
- Dutch Elm and other tree disease and dangerous trees (replacement of
elms, powers of authorities to fell dangerous trees).
- Research (AAIS).
- The application and procedures of tree preservation orders (superseded
by Tree Preservation Orders - A guide to the law and good practice. DETR 1994).
- Trees in conservation areas (superseded by above).
- Felling licenses (superseded - see Forestry Commission for latest
guidance).
- Trees and development (duty of LA, protection of trees during
development, tree roots and build development, consideration of applications, use of
conditions, tree preservation orders and development).
