            | This case
            involved an Elm tree which blew down in a storm killing the driver of a vehicle. On
            examination of the tree it was found to have a cavity with decay which would have been
            easily seen during a routine inspection. However, since the tree had not been inspected,
            no action had been taken to remedy the fault. Hence, the defendants were found liable and
            substantial damages were awarded to the plaintiff.  |
